Rim Sues Motorola

Canadian smartphone company RIM (the people behind blackberry) is sueing juggernaut Motorola.  RIM says that Motorola is practicing unfair competition by not allowing former employees to work for RIM.  Noncompete agreements are pretty standard in the tech industry (I had to sign one) but this case is kind of unique.  Apparently the two companies had an arrangement where they wouldn’t poach eachothers employees but that alledged contract supposedly expired in August.  RIM says that even though the agreement no longer exists Motorola still aren’t letting their people work for RIM even if they are being fired.  To me it just seems weird that a contract like that even existed and secondly why did it only exist until August?
